These terms and conditions apply to all services offered by AALERNHÜS, such as accommodation, the provision of conference and banqueting facilities for the implementation of events, and all further goods and services connected with them. They apply to the same extent for the provision of other facilities, display cases and spaces. Only the following terms and conditions will apply. The terms and conditions of customers (a uniform term for event organisers, guests and persons placing orders) will not become part of the contract, even if they are not expressly rejected.
The reservation of rooms and areas as well as the arrangement of other goods and services will become binding for both parties on confirmation by AALERNHÜS or, if this is no longer possible for reasons of time, by the provision of such goods and services. The reservation of rooms, display cases and spaces establishes a rental contract. Subletting the hotel rooms or using them for purposes other than temporary accommodation will require the prior written consent of AALERNHÜS. If the reservation is made by a third party, even if this third party has been authorised to do so by the guest, this third party becomes a contractual partner and is liable jointly and severally with the guest for all obligations arising from the contract.
Guests do not have a claim to the provision of specific rooms. The rooms to be allocated to the guest are determined on the day of arrival by ALERNHÜS. Rooms which have been booked are available to guests from 15.00 hrs on the day of arrival. Guests have no claim to their provision at an earlier time. Unless later arrival has been expressly agreed in writing or text form, AALERNHÜS will have the right after 18.00 hrs to rent the rooms to other guests.
In the case of rooms not used by guests AALERNHÜS must credit any earnings obtained from renting the rooms to other guests, as well as any costs saved. On the agreed date of departure guests must remove their belongings and make the rooms available to AALERNHÜS at the latest by 11.00 hrs. As compensation for any loss resulting from subsequent use of the room AALERNHÜS will have the right to charge half the room price (list price) up to 18.00 hrs and the full room price after 18.00 hrs. The guest will have the right to prove to AALERNHÜS that no loss was incurred or that the loss was significantly lower.
The prices charged will be in accordance with the valid price list at the time the service is provided. If VAT is applicable this will be included in the price. Any increase in VAT after the conclusion of the contract will be charged to the guest. If a fixed price was agreed and the period between the conclusion of the contract and the provision of the service is longer than six months, AALERNHÜS reserves the right to impose an appropriate price increase.
All AALERNHÜS invoices which are based on a contract are payable without deduction within 14 days from date of invoice. In every case AALERNHÜS will have the right to require the guest to make an advance payment to a reasonable level. If the above period allowed for payment is exceeded, guests will be in arrears of payment without the need for them to be sent a reminder. As soon as guests are in arrears AALERNHÜS will have the right to charge interest on arrears amounting to 3% above the base rate of the European Central Bank at the time. This is without prejudice to the assertion of further compensation claims for arrears. Any reminders which are issued after the guest is in arrears may be subject to a charge of €20 per reminder.
In the event of force majeure or other circumstances for which AALERNHÜS is not responsible and cannot influence, AALERNHÜS reserves the right to withdraw from the contract without this giving rise to claims for compensation on the part of the customer. If the customer fails to make use of a reserved room without informing AALERNHÜS in good time, the payment obligations listed in 5a) to 5e) have to be fulfilled. This applies regardless of the reason for the failure to make use of the room. The following deadlines for cancellations apply:
5a) All withdrawals and cancellations must be implemented in writing.
5b) Withdrawal is possible free of charge up to the 14th day before arrival. From 13 days before arrival we will charge 90% of the room price or package price.
5c) Withdrawals by groups (from 10 persons) are possible free of charge up to 90 days before the reserved day of arrival.
5d) In the case of withdrawals by groups, 70% of the room price will be charged from the 89th day before the day of arrival. In the case of withdrawals between the 28th and 15th day before the day of arrival we will charge 80% of the room price. From the 14th day before arrival we will charge the full cost of room and board without deduction.
5e) In the case of rooms not used by guests AALERNHÜS must credit any earnings obtained from renting the rooms to other guests, as well as any costs saved. If the room is rented to other guests, AALERNHÜS reserves the right to invoice the original guest for a €25 administrative charge in relation to the room price. Guests are recommended to conclude travel cancellation insurance.
Before the implementation of an event the organisers are responsible for obtaining, at their own expense and in good time, any official permits which are required. They are also responsible for complying with the terms of the permit and any public regulations applying to the event.
Newspaper advertisements and public invitations as well as sales activities require the prior written consent of AALERNHÜS. The hotel will have the right to cancel the event if its publication will have a negative effect on AALERNHÜS’s interests or if AALERNHÜS has justified grounds for assuming that the event will jeopardise the trouble-free operations, security or reputation of AALERNHÜS or its guests. In this event the organisers will have no claim to compensation.
If AALERNHÜS obtains technical or other equipment or facilities from third parties on behalf of the organisers, AALERNHÜS will be acting in the name and for the account of the organisers. The organisers will be liable for the careful treatment and orderly return of the equipment or facilities, and indemnify AALERNHÜS against all claims from third parties arising from the provision of the equipment or facilities. Organisers may only bring their own food and drinks with the prior written consent of AALERNHÜS. In this case a service charge will be payable.
Events are subject to the following cancellation periods:
– Free of charge up to 12 weeks before the date of the event on the basis of a written declaration. After that AALERNHÜS will have the right to charge the agreed fee for the facilities, unless they can be rented to another customer.
– In the event of cancellation up to 4 weeks before the date of the event, AALERNHÜS will have the right to charge for 20% of the lost catering turnover in addition to the agreed rent for the facilities. If no specific food and drink has been selected, the least expensive 3-course set meal will be the basis for calculation.
In the event of a later withdrawal AALERNHÜS will have the right to charge for 40% of the lost catering turnover in addition to the agreed rent for the facilities. The catering turnover will be based on the lowest set meal price x the number of persons.
Changes in participant numbers:
A change of more than 15% in the participant numbers must be notified to the banqueting department at the latest three working days before the event. It will require the approval of AALERNHÜS.
In the event of a higher number of participants the actual number of participants will be charged for. If there is a change of more than 40% in the number of participants, AALERNHÜS will have the right to recalculate its prices and to change the reserved room facilities, provided that the organisers can be reasonably expected to accept this. In this case too, the following applies: in all cases the customer will have the right to prove that the damage incurred was less, and AALERNHÜS to prove that it was greater.
In all cases any special services which become surplus to requirements because of the cancellation must be paid for. The organisers will be responsible for any losses or damage which is caused either by themselves, their employees or guests. The organisers are responsible for concluding the relevant insurance cover. AALERNHÜS will be entitled to require proof of such insurance cover. In order to prevent damage, the application of decorative materials or other objects will require the written approval of AALERNHÜS. If the event affects the rights of third parties (copyright etc.), the organisers will be responsible for paying the relevant fees (GEMA etc.) directly before the event takes place. If claims for damages are asserted against AALERNHÜS in spite of this, the organisers will indemnify AALERNHÜS against claims from the rights holders.
The hotel will make every effort to implement early-morning calls punctually, and pass on messages and goods messages and goods to guests correctly and in good time. Any objects which are found will be sent on to the guest only at the request, cost and risk of the guest. The object will become the property of the finder if it is not claimed within one year from the time at which it was found. No liability on the part of AALERNHÜS will arise from the above points. If the guest is allocated a parking space in AALERNHÜS’s own car park or in a different location, either free or against payment, this will not provide the basis for a contract of safe custody. The hotel will have no surveillance obligations in relation to the vehicle. The hotel will only be liable for direct damage to the vehicle which is caused by any defect in the parking space already in existence at the time it was allocated, but only to a maximum of 15,000.00 euros per vehicle including accessories. The damage must be reported to AALERNHÜS at the latest on departure from the AALERNHÜS grounds. Guests use the leisure facilities provided by AALERNHÜS at their own risk. Any technical or personal objects brought by the organisers remain in the rooms used for the event at the risk of the organisers. The liability of AALERNHÜS and its staff is limited to deliberate wrongdoing and gross negligence.
In accordance with § 36 VSBG AALERNHÜS is obliged to inform you that you have the opportunity to participate in a resolution process for consumer disputes in accordance with the legislation on the resolution of consumer disputes. AALERNHÜS is neither prepared nor obliged to participate in a dispute resolution process before a consumer dispute resolution organisation. In accordance with § 37 VSBG the following will apply to any disputed already commenced: the dispute resolution organisation responsible for AALERNHÜS is the General Dispute Resolution Office of the Zentrum für Schlichtung e. V., Straßburger Straße 8 in 77694 Kehl, Tel.: +49 7851 79579 40, Fax: +49 7851 79579 41, Email: firstname.lastname@example.org. AALERNHÜS does not participate in the consumer dispute resolution process in accordance with the legislation on the resolution of consumer disputes before the above-mentioned consumer dispute resolution organisation.
If any provision of these terms and conditions is invalid, this will not affect the validity of the remaining provisions. Instead of the invalid provision, whatever provision comes closest to the purpose of the invalid provision will apply. Any divergent agreements and supplementary arrangements will only be valid if concluded in writing. To the extent permissible the place of fulfilment and jurisdiction is AG Hamburg. The laws of the Federal Republic of Germany have sole application.
